Mesothelioma is a disease that is caused by asbestos exposure. It is a rare form of cancer that develops from transformed cells originating in the protective lining that covers several internal organs in the human body, such as the lungs and the heart.
The majority of people who develop mesothelioma have been exposed to asbestos through their work, inhaling fibres which cause the cancer to develop most often around the lungs.
Mesothelioma has a long latency period and usually does not develop until 15 to 60 years after you have been exposed to asbestos. Because of the heavy use of asbestos in British industry until the 1970’s, the number of cases in the UK is expected to rise over the next few years as those exposed earlier in life finally begin to develop the disease.
Much was known about the dangers of asbestos particularly from the late 1960's onwards and in the absence of suitable measures to protect workers and visitors to sites where the risk of inhaling asbestos fibres was significant will be deemed a breach of their duty of care and their insurers will be held liable to pay compensation.
We understand how important it is to move quickly in these cases and for this reason we will always give priority to our clients affected by Mesothelioma.
If you have developed mesothelioma following asbestos exposure through work in England and Wales (regardless of where you now live) you may be able to claim compensation. Although many of the companies responsible for our clients’ wrongful exposure to asbestos may no longer exist, it is still often possible for us to successfully recover compensation.
We will obtain details of your employment and medical history, send off for your medical records and undertake searches with HMRC, Companies House, the Employers Liability Tracing Office/Association of British Insurers. Where necessary we will apply to the High Court to restore dissolved companies to the Company Roll. We will then secure expert medical opinion and seek to negotiate a settlement with the traceable liability insurers concerned.
As well as pursuing a compensation claim against the relevant insurers we can assist clients in claiming a lump sum payment under the Pneumoconiosis Etc. (Workers’ Compensation) Act 1979 as well as assisting with Constant Attendance Allowance applications for 24 hour care.
Compensation awards are made not only to workers directly exposed to asbestos in the workplace but also those who may have been affected by asbestos brought home on the clothing of other family members.
Our clients’ mesothelioma claims are funded by entering Conditional Fee Agreements (No Win - No Fee) with us at no cost to the client as our costs including the 'success fee' are paid by the insurers.
